Terms and conditions

Please read these Terms and Conditions ("Terms" or "Terms") carefully before using the DreamWell application ("Service") operated by PT Dream Wisata Indonesia ("We" or "Company") within the Netzme application. If you use the "Services", you will be deemed to have read and agreed to these "Terms". These “Terms” apply to all visitors, users and others who access or use the “Services”. By accessing or using the "Services", you agree to be bound by these "Terms". If you do not agree with the “Terms” section, you should not use this “Service”.

  1. Scope
    • These terms and conditions apply to all users, some or all of the services available at DreamWell.
  2. Account
    1. Before you create an account, you must provide accurate, complete and up-to-date information at all times. Submission of incorrect information is a violation of the Terms, which may result in the immediate termination of your account on our Service. You are responsible for protecting the password, sim card and mobile phone that you use to access the Service and for any activity or action for any consequences that related to this matter, whether your password with the Service or our third party services.
      • You agree not to disclose your password, share your sim card and or mobile phone to any third party. You must notify us as soon as you become aware of any breach of security or unauthorized use of your account.
      • You may not use other people's nicknames, other entity names, illegal names, names or trademarks that are subject to the copyright of other people or entities, names that are offensive, vulgar or obscene.
      • You are not allowed to upload and/or share negative content such as pornography, racism, which can be an expression of hatred and so on.
      • To use the service, you may be required to upgrade your account by registering an Identity Card, Selfie along with an Identity Card and Birth Mother's Name and other information if needed by us in the future or due to regulatory changes from payment service supervisors, monetary authorities, government agencies, other authorities and third parties who have direct interests based on applicable laws and regulations.
    2. After you submit the required data and documents, we will verify the data and documents submitted and then determine whether you meet the requirements as a verified Netzme User.
    3. We hold full authority in giving approval and/or rejection of your verification application with due observance of applicable law. If there are doubts and/or incomplete documents and/or information that you provide, we reserve the right at any time to withdraw approval of your request as a verified Netzme User and cannot be separated from returning your status to an unverified Netzme User.
    4. To avoid misuse of your Netzme account, if the data and documents that you submit are incomplete, expired, and/or completed but not appropriate, then we have the right to stop your DreamWell service.
    5. Netzme account registration can be done by yourself and/or a business entity as a legal subject. If the Netzme account registration is carried out by a business entity, then the responsibility for the account is borne by the User who volunteers as a verified User.
    6. The data and documents that you submit to us for verification requests are your own data. Any use and/or request for services and activity on Netzme in any account will be deemed as a legitimate use and/or request from that account.
  3. Personal Data Information
    1. When registering personal data information, you agree that your data will be stored and you agree that we use or disclose your personal data in accordance with applicable laws and regulations and you agree to the privacy policy that applies to the Netzme application.
    2. To comply with the rules that apply in Indonesia, including in terms of anti-money laundering and prevention of terrorism financing, we have the right to request additional information from you and you agree to comply with all requests that we make in any form without exception in accordance with applicable regulations. Any additional information that you provide at our request, we will consider as information provided by you and we are not responsible for verifying the accuracy of that information.
    3. To maintain our integrity and your trust, we will not share your information with any party except payment service supervisors, monetary authorities, government agencies, other competent authorities and third parties who have a direct interest based on applicable laws and regulations.
  4. Agreement
    1. You are specifically bound by these Terms and Conditions and you represent and warrant that you are a legal individual to be bound by an agreement based on the laws of the Republic of Indonesia and you are at least 17 years old or married and not currently under guardianship. For users under the age of 17, it can be represented and approved by a guardian (user's parents or your guardian).
    2. You waive any rights under law to cancel or revoke any and all agreements that you give based on these Terms and Conditions when you are deemed by law to be an adult.
    3. You grant us the right and license to use, modify, display, reproduce and distribute such Content on and through the Services. You retain any and all of your rights in the Content that you submit, post or display on or through the Services and you are responsible for protecting those rights. You agree that this license includes the right to make your Content available to other users of the Service, who may also use your Content under these Terms.
  5. Service
    1. The Netzme application consists of messaging, social media and payment services.
    2. For messaging and posting services on social media, we use third parties in the delivery process from you to other users. Third parties may store all the information you submit.
    3. Some services in the Netzme application (such as topping up balances, cash withdrawals, transfers to banks, PPOB purchases or services that appear in the future) cannot be paid for with DreamWell Points balances.
    4. You understand that services through third parties may experience system and/or network interruptions from time to time. As a party that works with third parties, we will always try to maintain the level of service.
    5. Third parties that work with us, may provide services for purchasing DreamWell point balances from your third party funding sources. If you use this service, you understand that the registration for this service is done directly to the third party. Our responsibility is limited to forwarding requests or instructions from you to third parties. Complaints or errors arising from registration of DreamWell points balance services, authentication, and/or third party systems are not our responsibility.
    6. Services or features such as direct debit and/or auto top up balances or other services that require data information will be stored in a Netzme account and you have agreed and understood the storage of such data information. Thus you understand the risks that will arise in point 5.4 above. For the avoidance of doubt, all risks that arise due to your mistakes and/or negligence and/or other factors that are not our fault, are your full responsibility as the owner of the Netzme account.
    7. Withdrawal of DreamWell point balances and transfer of DreamWell point balances cannot be done and is attached to Netzme account holders during the validity period of DreamWell point balances, which is 1 year from the date of purchase of the DreamWell Voucer Package.
    8. Any losses and/or problems arising from the services mentioned in point 5.1 due to system failure by third parties will not be our responsibility. We will receive complaints from you about the problem and forward it to a third party for follow-up.
  6. Limits on Balance and Transactions
    1. The number of DreamWell Points balance in your Netzme account is unlimited and DreamWell Points Packages can be purchased according to the user's wishes.
    2. Netzme is not a banking institution. So you understand that your DreamWell points balance is not savings and is not subject to the Deposit Insurance Corporation's protection program and no services or benefits are received in the bank account (such as interest, etc.).
    3. The limit for DreamWell Point balances and the incoming monthly transaction limit may change at any time following the policies and regulations of payment service supervisors, monetary authorities, government agencies, other authorized authorities.
    4. All transactions (purchase of DreamWell Points Packages, exchange of DreamWell Points to promo vouchers, paying with promo vouchers, etc. that are transacted at DreamWell service & DreamWell website at www.mydreamwell.com) that have been made by the users are final and cannot be reversible in any way.
  7. Usage
    1. You may not impersonate another person, and you may not create an account for another person, unless you have obtained express permission from that person.
    2. You may not post personal information, confidential information, or do anything that violates the property rights of others, including intellectual property rights.
    3. Your DreamWell Points balance can be used entirely to zero (Rp 0) according to these terms and conditions.
    4. It is possible for transactions and activities that you carry out at DreamWell to be carried out with business actors who are third parties who already have an agreement with us.
    5. Procedures for use and/or payment at DreamWell may change and/or increase at any time, it is also possible if you are required to update your Netzme application.
    6. You cannot make payments and/or transactions that exceed your DreamWell Points balance. DreamWell Points balance will be reduced automatically according to the amount entered or confirmed by you.
    7. All promotional vouchers are based on availability at each participating partner location, if there is a promotional variant that is not available, then the promo shall not be paid to participating partners. Users must inquire in advance before ordering at participating partner locations to obtain product availability for each participating partner promo voucher.
    8. Transactions that you have confirmed and have been processed by us cannot be cancelled.
    9. Expiration date of each promotion is stated on every promo voucher, should the promo voucher had been redeemed and not yet used (paid) up to the end of promo validity period, voucher will be expired and points could not be refunded (expired).
    10. The price on the promotional voucher refers to the price listed on the DreamWell service in the Netzme application, if there is a price difference between the price stated on the application and the website (mydreamwell.com), then the price on the DreamWell service in the Netzme application shall be the prevailing price.
  8. Authentication and Security
    1. To maintain the security of your Netzme account, the use of a PIN with 6 sequential numbers is required to authenticate your Netzme account. The PIN code is used to make transactions and/or features specified by us.
    2. You are required to keep your PIN code secret. If there is a loss caused by your negligence in maintaining the confidentiality of your PIN code, it is your responsibility. Any sending of a verified PIN from your account will be considered as a valid transaction and/or activity.
    3. To enter the Netzme application for the first time or other valid authentication methods later, you will need to verify the OTP, which will be sent via SMS to your registered telephone number and/or via electronic mail. We and our staff will not ask you for this OTP. By disclosing the OTP to a third party, you agree to assume all risks that occur and are fully responsible for the consequences associated with it.
    4. We can provide other authentication methods, not limited to fingerprint, iris and/or facial recognition authentication that are enabled by the device you are using. This authentication method may require a PIN before activation.
    5. Authentication factors that can be identified can be stored and verified by us or third parties (such as your device or parties who work with us, such as verification service providers that have been recognized by law and regulation). Any claims related to storage and/or verification of factors identifiable by third parties (such as your device) will not be our responsibility. However, we will make reasonable efforts to minimize risks that we can identify that may arise from the activity and/or use of authentication factors.
  9. Account Blocking
    1. You can block your Netzme account and use of your DreamWell service at your own request. In addition, if in our opinion, if things happen that cause losses and/or can harm us or you or other third parties, we can do the blocking. Account blocking can occur due to:
      • If there is a report from you because your cell phone was stolen or lost or hacked;
      • There is an order from a government institution or based on a court order;
      • Use of a Netzme account that violates these terms and conditions, terms and conditions of use of the Netzme application, other terms and conditions that apply to other features or services in the Netzme application, Netzme's privacy policy and any applicable laws and regulations, and is not limited to fraud and use of fake documents;
      • Other reasons that cause harm to you or us, including abusive and fraudulent actions or when our system catches unusual (suspicious) transaction patterns.
    2. You can file a complaint if your Netzme account is blocked by providing strong evidence that nothing suspicious has happened. We have the full right to decide to end or continue blocking your Netzme account after examining your complaint.
  10. Account Closure
    1. Your Netzme account may be closed for the following reasons:
      • Your request;
      • Our policy is based on applicable laws and regulations and legislation;
      • Force majeure for 3 (three) months or more consecutively; and/or
      • Another reason in connection with account blocking.
    2. Your Netzme account will be officially terminated or closed when you meet the requirements requested by us.
    3. We may refuse transactions made by you if you violate some or all of these Terms and Conditions and/or violate applicable laws and regulations.
  11. Cost

    In using the DreamWell service, you may be charged a fee, including but not limited to fees related to the purchase of a DreamWell Voucher Package as a transaction fee made through a third party channel.

  12. Your Responsibilities and Obligations

    You are responsible for:

    1. Security and ownership of your mobile phone used to access the DreamWell application within the Netzme application. This includes availability of storage memory, availability of internet network and/or damaged mobile phones which can cause failure or disruption of any services.
    2. The security and validity of the telephone number that you registered to use the Netzme application. We are not responsible for claims and/or transactions that occur if your telephone number is used by a third party whether it is with your knowledge or not due to your negligence in maintaining the cellphone you are using.
    3. The OTP sent to you and/or the PIN set by you is your responsibility.
    4. You must be careful every time you use your Netzme account and/or DreamWell services, be it transactions, payment purposes, uploading photos/videos and so on.
    5. You are fully responsible for all content and/or conversations that you upload to the Netzme application.
    6. Any losses, claims, demands and/or costs incurred, including from other parties to us, arising from violations of these Terms and Conditions, your mistakes in using your Netzme account, DreamWell services, DreamWell features and/or DreamWell applications, including but not limited to those caused by carelessness in acting, carelessness or misuse of your Netzme account and/or DreamWell services by you or other parties using your Netzme account.
  13. Our Responsibilities
    1. We are only responsible for the direct losses incurred, namely the amount due, incurred during the use of the Netzme account, which can be proven to have occurred due to an error in our system or our violation of these terms and conditions based on a court decision. Our maximum responsibility is limited to the number of transactions reported.
    2. We are not responsible for indirect and immaterial losses, including costs, damages or losses of any kind or kind that you or a third party experience and are not limited to the fault of you or a third party other than us.
  14. Compensation

    By registering and using a Netzme account and DreamWell service, you agree to release us, our licensors, our affiliates and each of our employees, directors, commissioners, employees, representatives and agents, from and against any and all claims, costs, damages, losses, responsibilities and expenses (including attorney fees) arising or in connection with:

    1. Your violation of these Terms and Conditions or applicable laws and regulations, whether referenced here or not;
    2. Your violation of other third party rights in connection with the DreamWell service;
    3. Any use or misuse of the DreamWell service by you or any other party using your Netzme account;
    4. Any mistakes made by parties other than us, whether intentional or in the form of negligence; or
    5. The blocking of your Netzme account is based on the matters set out in these Terms and Conditions. These indemnification provisions will remain in effect regardless of the termination of your Netzme account.
  15. Problems and Complaints
    1. Your data and balance and/or transaction history is recorded in our system which is final data and binds us and you. We do our best to keep the system secure.
    2. We apply reasonable security standards to safeguard your data stored on our systems. However, we would like to emphasize to you that there is no impenetrable system that could pose a risk to the use of your Netzme account and the DreamWell service. Therefore you agree to release us from any claims arising from damage, interference, viruses and so on caused by parties other than us.
    3. You agree and are not permitted to tamper with, alter or modify your Netzme account in any way.
    4. We need you to understand that in using DreamWell services through third parties, there is a possibility of system failure from these third parties and we are not responsible for these problems.

  16. Correct
    1. We can make corrections to your DreamWell Points balance if according to our records there is an error in the transaction. We will not make corrections to your balance if there is no evidence or a strong basis for an error in the transaction. You can submit a correction request to us through the channels we have provided.
    2. In connection with this correction, you agree to authorize us to debit and/or credit your DreamWell Points balance. This power of attorney will continue to apply and cannot end until you close your account.
  17. Force Majeure

    You agree to release us from any claims, if we are unable to fulfill the instructions you made through your Netzme account due to force majeure. We do not guarantee that our service will be interrupted by certain events or things that are beyond our authority and power, including but not limited to telecommunications disruptions, natural disasters, power outages, government policies and other matters beyond our control.

  18. Intellectual property rights

    DreamWell's name, logo, code, technology, design, business model are protected by copyright, trademark and other intellectual property rights under the laws of the Republic of Indonesia. You are not permitted to trade, copy, license, disassemble any part by exploiting the DreamWell system except as permitted in these Terms and Conditions. Not apart from creating competitive products and services by using ideas, functional features and similar graphics, reengineering, using robots, web spiders, web crawlers, viruses, worms or the like for your benefit without our consent.

  19. Language

    These Terms and Conditions are made in Indonesian in accordance with the legality of the domicile of PT Dream Wisata Indonesia company. Should there be any discrepancies between English and Indonesian version, we refer to the Indonesian version.

  20. Diversion

    You are not allowed to transfer your account to another party based on these terms and conditions and you guarantee that the use of the Netzme account is only used by you and for your own interests as the legitimate account holder.

  21. Governing Law

    These Terms and Conditions are governed by the laws of the Republic of Indonesia.

  22. Changes

    These terms and conditions, in part or in whole, including the features or services offered in the Netzme account, may be modified, added or changed from time to time without notice to you. If you reject such modifications, additions and/or changes, then you must stop accessing or using the DreamWell service.

Privacy Policy

DreamWell provides sales of promo vouchers, payment services and other services to users around the world, according to Indonesian rules and regulations.
